User / You: Refers to any individual or entity using the Platform, including Job Seekers and Recruiters.

Job Seeker: An individual registering on the Platform to search for job opportunities and/or utilize career services.

Recruiter: Any individual, corporate entity, or placement agency posting job vacancies, accessing the resume database, or utilizing other paid/premium services.

Content: Any data, text, graphics, images, audio, video, software, and other information posted, uploaded, transmitted, or displayed on the Platform.

 2.⁠ ⁠Eligibility and Authority

You represent and warrant that you are at least 18 years of age and are legally competent to enter into a binding contract under the Indian Contract Act, 1872. If you are accepting these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind such entity.

 3.⁠ ⁠User Accounts and Registration

3.1 Account Responsibility

You are responsible for maintaining the confidentiality of your account access information (username, password) and are solely responsible for all activities that occur under your account. You agree to notify The Company immediately of any unauthorized use of your account.

3.2 Accuracy of Information

You agree to provide true, accurate, current, and complete information during registration and to promptly update your information as needed. The Company is not responsible for any loss or damage arising from inaccurate or incomplete information provided by you.

 4.⁠ ⁠Specific Terms for Job Seekers

4.1 Resume and Profile Data

By creating a profile, you grant The Company a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and share your resume, profile data, and Content with potential Recruiters, employers, and authorized third-party services.

4.2 Disclaimer on Job Match

The Company acts as an intermediary. We do not guarantee that you will receive a job offer, that the job positions are valid, or that the Recruiters are genuine. You are solely responsible for conducting your own research before accepting any job offer or providing personal/financial information to a Recruiter.

4.3 Fees

The Company is not responsible for any fees charged by any Recruiter or third party. You agree to exercise caution and report any suspicious requests for money.

 5.⁠ ⁠Specific Terms for Recruiters

5.1 Job Postings

You are solely responsible for the Content of your job postings and agree that they will:

a. Be genuine, current, and for an available job opening.

b. Not contain any false, misleading, or deceptive information.

c. Comply with all applicable Indian laws against discrimination, including those related to age, gender, caste, religion, etc.

5.2 Database Usage

Access to the resume database (if provided) is granted solely for the purpose of recruiting and hiring prospective employees. You agree not to use the data for any commercial use, soliciting, advertising, or mass mailing unrelated to an actual job opening.

5.3 Termination of Services

The Company reserves the right to immediately terminate or remove any job posting or recruiter account without refund or liability if we believe the posting or user is violating these Terms or engaging in fraudulent activity.

 6.⁠ ⁠Prohibited Uses and User Conduct

You agree not to use the Platform in any way that:

a. Is unlawful, fraudulent, defamatory, abusive, threatening, or harassing.

b. Infringes upon the intellectual property rights of The Company or any third party.

c. Uploads, posts, or transmits any Content that is harmful, vulgar, obscene, or racially, ethnically, or otherwise objectionable, as per the Information Technology Act, 2000 and other relevant Indian statutes.

d. Uploads files containing viruses, malware, or any other destructive code designed to interrupt, destroy, or limit the functionality of any computer resource.

e. Attempts to decipher, decompile, or reverse engineer any part of the Platform.

f. Solicits passwords or personally identifiable information for commercial or unlawful purposes from other users.

 7.⁠ ⁠Intellectual Property Rights

The Platform, including its software, graphics, design, compilation, and all Content (excluding Content provided by Users), is the exclusive property of Naukari Express India OPC Pvt Ltd and is protected by Indian and international copyright, trademark, and other intellectual property laws.

 8.⁠ ⁠Disclaimer of Warranties

The Platform and all services are provided on an "AS IS" and "AS AVAILABLE" basis. The Company makes no representations or warranties of any kind, express or implied, regarding the operation of the Service or the accuracy, reliability, or completeness of the Content provided by third parties (Recruiters or Job Seekers).

 9.⁠ ⁠Limitation of Liability

To the maximum extent permitted by law, Naukari Express India OPC Pvt Ltd, its directors, employees, or agents, shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or other intangible losses, resulting from:

a. Your access to or use of the Service.

b. The conduct or Content of any third party on the Service (e.g., fraudulent job postings).

c. Unauthorized access, use, or alteration of your Content or transmission.

10.⁠ ⁠Indemnification

You agree to defend, indemnify, and hold harmless Naukari Express India OPC Pvt Ltd and its directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt arising from:

a. Your use of and access to the Service.

b. Your violation of any term of these Terms.

c. Your violation of any third-party right, including without limitation any intellectual property, privacy, or proprietary right.

11.⁠ ⁠Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. You agree that the courts located in India, shall have exclusive jurisdiction to resolve any disputes arising under these Terms.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
